Arbitration

When your Terms require arbitration

Many websites' own terms of use send disputes to arbitration. Where yours do, a matter that is not resolved proceeds there, under the rules your Terms choose.

How it starts

Where your website's own Terms require arbitration, the claimant commences it with the administrator those Terms name, such as the American Arbitration Association (AAA), JAMS, or National Arbitration and Mediation (NAM), under the rules the Terms incorporate.

Any step your Terms require before arbitration comes first. If they call for written notice by a particular method or to a particular address, notice is given that way. If they set an informal-resolution period, the claimant waits it out before filing.

Where your Terms do not require arbitration, the letter states where the claim proceeds: the court your Terms name, or otherwise a civil action under 18 U.S.C. § 2520.

Who pays the administrator's fees

A claim by a website visitor against the business whose Terms require arbitration is a consumer arbitration under each administrator's rules. Under each consumer fee schedule, the individual pays a capped filing fee and the business pays the rest.

American Arbitration Association (AAA)

The individual who starts the case pays a filing fee capped at $225.

The business pays its own filing fee, the case management fee, any hearing fees, the arbitrator’s compensation and the arbitrator’s expenses.

JAMS

When the consumer starts the case, the only fee the consumer pays is $250.

The company pays all other costs, including the rest of the filing fee, the case management fee and the arbitrator’s professional fees.

National Arbitration and Mediation (NAM)

The party who files the claim pays a $225 filing fee.

The business pays the administrative fee, the case management fee, any hearing fee and the arbitrator’s time.

Under the AAA and NAM schedules, the business's first fees fall due once a demand is filed and are not refunded if the matter settles later. Each administrator decides which of its rules and fee schedules applies to a case. Figures are from each administrator's published schedule, checked October 22, 2026.

How this fits the letter's deadline

The deadline in the letter is the time to resolve the matter before any proceeding begins. When your Terms require notice and a waiting period before a claim is filed, the letter's deadline runs at least to the end of that period.

A matter that is not resolved by the deadline proceeds in the forum your Terms name. Resolving it before a demand is filed means neither side pays an administrator's fee.

You may ask for more time in writing. A deadline moves only when the claimant confirms the new date in writing.
