Acceptance and authority
By accessing or using the Privacy Resolve website or secure portal, you agree to these Terms. If you use the service for a business or other entity, you represent that you are authorized to act for it. Do not use the service if you do not agree.
A recipient may permit its attorney to review, negotiate, sign, or arrange payment through an authorized portal role. Privacy Resolve may rely on actions taken through valid recipient or attorney access unless it has actual notice that access was revoked or unauthorized.
The service
Privacy Resolve provides a secure portal for reviewing matter-specific correspondence and evidence, communicating, negotiating, executing settlement documents, arranging ACH payment, and receiving completed records. Features may change for security, legal, operational, or provider reasons.
A demand, portal summary, evidence record, or negotiation is not a court judgment. Filing, liability, damages, settlement, and any outcome depend on the facts, applicable law, and actions of the parties. Nothing in these Terms changes the specific terms of an executed settlement agreement.
No attorney-client relationship or legal advice
Privacy Resolve is a compliance-resolution service. Use of the service does not create an attorney-client relationship. Portal explanations, portal summaries, design examples, and chat responses are general or matter-support information, not legal advice to the recipient. You may consult independent counsel before acting.
The claimant is currently proceeding pro se unless the case materials expressly identify separately engaged counsel. AI output is not attorney-reviewed unless the portal expressly says otherwise for a particular communication.
Artificial-intelligence features
The portal assistant may use artificial intelligence to explain portal features and matter data. AI output can be incomplete or inaccurate, may not reflect current law, cannot bind either party, and is not a substitute for professional advice. Do not submit unrelated confidential or sensitive information to the assistant.
Replies to correspondence about a matter may be drafted with AI. A person reviews each one before it is sent.
Access and account security
Access is limited to the matter recipient and people the recipient authorizes. The printed case code, a registration link, an attorney invitation, and a signed-in session are credentials. Keep them secure and notify Privacy Resolve promptly if you believe they were exposed or misused. We may rate-limit, revoke, or suspend access to protect a matter or the service.
Acceptable use
You may use the service only to review and address the matter for which access was issued.
- Do not provide materially false information, impersonate another person, or act without authority.
- Do not access another matter, defeat authorization or rate limits, probe security, introduce malicious code, scrape the service, or interfere with operation.
- Do not use the service to harass, threaten, publish protected case material, or violate law or another person’s rights.
Case materials, confidentiality, and intellectual property
The software, design, compilations, and original service content are owned by Privacy Resolve or its licensors. You receive a limited, revocable right to use them for your matter. Evidence, correspondence, and settlement materials may contain confidential, proprietary, personal, or legally protected information. You may share them with your authorized attorney, insurer, accountant, technical adviser, or another person who reasonably needs them for the matter, subject to law and any settlement-specific confidentiality terms.
Electronic signatures and settlement agreements
Electronic signatures are completed through a secure third-party signing service. Under the claimant’s standing authorization, the portal applies the claimant’s electronic signature only after it creates the final, identity-complete agreement; the recipient or its authorized attorney reviews and signs next. A settlement is fully executed only after both required signatures are complete. The executed agreement, not a portal mockup or summary, controls the parties’ rights, payment timing, release, confidentiality, remediation, default, and enforcement.
You consent to transact electronically and to receive agreements, notices, and records electronically. You may download or print records for your files.
Payments
Settlement payments made in the portal are processed as ACH payments through embedded Stripe components after the agreement is fully executed. Stripe, not Privacy Resolve, collects sensitive bank credentials. A browser confirmation is not proof of final payment; provider webhook status and cleared funds control.
When an executed agreement provides for payment by bank transfer, pay only to the written instructions the claimant sends with the signed agreement, and confirm them by calling (888) 649-4500 before sending funds. Privacy Resolve never changes payment instructions by email alone.
The executed agreement controls the amount, due date, refunds, reversals, default, and enforcement. The portal does not add filing fees, attorney fees, processing fees, or other charges merely because a deadline passes or an event occurs. Any additional amount must have a valid contractual or legal basis and be accurately reflected in the controlling record.
Communications
You consent to receive transactional emails and portal notices reasonably related to the matter at the addresses you provide. Email delivery is not guaranteed, so you remain responsible for the deadlines in the correspondence and the executed agreement.
SMS is available for recipient-initiated case support through our carrier-verified toll-free number. The text-message assistant answers general questions right away. A recipient may authenticate the text conversation with the eight-character access code printed in the notice and then discuss the corresponding notice, evidence, deadline, demand, and resolution options. Signing, submitting a proposal, uploading documents, and payment remain secure-portal actions. If you initiate a text conversation, the SMS Terms apply. Message and data rates may apply; reply STOP to opt out and HELP for help.
Availability and warranties
The service is provided as available. We work to keep it secure and operational but do not promise uninterrupted or error-free availability. To the fullest extent permitted by law, the service is provided without implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement. Provider outages, maintenance, security events, force majeure, and internet failures may affect availability.
Limitation of liability and indemnity
This section applies only to service disputes, as defined in the next section. To the fullest extent permitted by law, Privacy Resolve and its affiliates, personnel, and providers are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the website or portal. Aggregate liability for service disputes is limited to $100. Recipients pay no fees to use the service. Settlement payments under an executed agreement are not fees for the service, do not raise this limit, and are not limited by it. These limits do not apply where prohibited by law.
You are responsible for losses arising from your unlawful use, material breach of these Terms, unauthorized access you cause, or infringement of another person’s rights. Any indemnity is limited to the extent enforceable under applicable law.
Service disputes and arbitration
A service dispute is a dispute about these Terms, the website, or the portal. This section, the limitation of liability above, and the choice of court below apply only to service disputes. They do not govern the underlying claim described in a letter, which proceeds in the forum the letter states: the court or arbitration provider named in the recipient’s own website terms, or otherwise a civil action under 18 U.S.C. § 2520. An executed settlement agreement governs disputes under that agreement.
Before starting a proceeding over a service dispute, the party raising it must send written notice describing the dispute and the relief requested, and then allow 60 days to resolve it informally. Notice to Privacy Resolve goes to contact@privacyresolve.com and to Privacy Resolve, 14 Harwood Ct, Suite 415 #1058, Scarsdale, NY 10583. Notice to you goes to the email address you provided.
A service dispute not resolved within those 60 days will be resolved by individual binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, because recipients use the service as businesses, or under its Consumer Arbitration Rules where the AAA requires them. The AAA’s mass-arbitration supplementary rules apply where their own thresholds are met. Either party may instead bring an individual claim in small claims court if the claim qualifies there, and either party may seek temporary injunctive relief in court to prevent irreparable harm.
You may opt out of arbitration under this section by emailing contact@privacyresolve.com within 30 days after you first access the service. Class, consolidated, and representative proceedings and jury trial are waived to the extent enforceable.
Governing law and general terms
New York law governs these Terms without regard to conflict-of-law rules. Claims not subject to arbitration must be brought in state or federal courts serving Westchester County, New York, to the extent legally permitted.
If a provision is unenforceable, it will be narrowed as needed and the remainder will continue. A failure to enforce is not a waiver. These Terms, the Privacy Policy, and any executed settlement agreement form the applicable agreement for their respective subjects; the executed settlement agreement controls any conflict about the settlement. We may update these Terms prospectively by posting a new date and providing additional notice when legally required.
